Terms of Service

1. Definitions and acceptance
These Terms of Service (the “Terms”) govern use of the Skyden mobile application (the “Application,” “Skyden,” or the “Service”) and associated services.
- Skyden means the digital pilot-logbook application and its associated services, features, and content.
- User or you means any individual using the Application.
- Publisher, we, or us means Guillaume Huchet, the publisher of the Application, operating in France.
By accessing, downloading, or using Skyden, you expressly accept these Terms. If you do not accept them, you must stop using the Application.
2. The Service
Skyden is a digital flight-logbook application for aircraft pilots. It supports recording and managing flights, calculating flight-time totals, synchronizing data across devices, exporting and backing up flight data, tracking ratings and licence validity, and recording digital signatures associated with flights.
The Application requires a user account and cloud connectivity. An offline mode lets you view and enter flights while temporarily disconnected; data synchronizes when connectivity returns.
3. Access conditions
3.1 Minimum age
You must be at least 16 years old to use Skyden.
3.2 Registration
You must create an account and provide accurate, complete, current information. You must keep your login credentials confidential.
4. Subscriptions and pricing
4.1 Subscription plans
Skyden offers plans whose features, prices, and conditions are shown in the App Store when you subscribe. Free trials or promotional offers may be available under the terms shown at purchase.
4.2 Automatic renewal
Subscriptions renew automatically at the end of each period unless automatic renewal is disabled at least 24 hours before the current period ends, in accordance with App Store rules.
4.3 Subscription management
You can manage a subscription and disable automatic renewal in your App Store account settings. A current subscription cannot be cancelled before its term ends.
4.4 Pricing
Prices may vary by location and App Store conditions. The price displayed when you subscribe or renew applies.
4.5 Refunds and withdrawal
Apple bills and manages purchases and subscriptions. Skyden does not receive payments directly and cannot issue refunds. Refund or withdrawal requests must be sent to Apple and are handled under App Store terms. This does not affect mandatory consumer rights under applicable law.
5. Use of the Service
5.1 Permitted use
Skyden is intended only for personal flight-logbook management. You agree to use it for its intended purpose, enter only flights actually performed, comply with applicable laws and regulations, and respect third-party rights.
5.2 Prohibited use
You must not enter fictitious flights, use the Application illegally or fraudulently, bypass security controls, reverse engineer the software, transmit malicious code, or interfere with its operation.
5.3 Third-party data
You may enter personal data about other people, such as co-pilots or instructors. You alone are responsible for ensuring that doing so is lawful and, where necessary, that you have their consent or another valid authorization.
5.4 Suspension or termination
We may immediately suspend access where there is serious evidence of fraud, a security threat, unlawful use, or infringement of Skyden’s intellectual-property rights. For a serious or established breach—including unauthorized copying, reproduction, reverse engineering, or exploitation—we may terminate access without notice or compensation. Other breaches are handled under section 9.2.
6. Intellectual property
6.1 Ownership
The Application and its original elements—including source and object code, architecture, interface, graphics, text, content, databases, trademarks, logos, and visual elements—are protected by intellectual-property rights and remain the exclusive property of Skyden or their respective owners.
6.2 Licence
Subject to these Terms, Skyden grants you a personal, limited, non-exclusive, non-assignable, non-transferable right to use the Application for its intended purpose while you have access to the Service. No other right is granted.
6.3 Reproduction and exploitation
Unless Skyden gives prior written authorization, and subject to mandatory legal exceptions, you must not:
- Reproduce, copy, adapt, translate, modify, distribute, or commercialize all or part of the Application or protected elements
- Decompile, disassemble, reverse engineer, or attempt to access source code
- Extract or reuse a substantial part of Skyden databases, or perform repeated and systematic extractions
- Use access to the Application, interface, content, or protected elements to design, develop, or market a competing product that reproduces them
- Remove or alter intellectual-property, copyright, or trademark notices
6.4 User data
You retain ownership of data you enter. By using Skyden, you grant us a limited licence to process that data to provide the Service.
7. Personal data and backups
Personal-data processing is governed by our Privacy Policy, which forms part of these Terms.
You are responsible for backing up your flight data. We recommend regular exports even though we maintain technical backups.
If you stop using Skyden or a subscription ends without an erasure request, we retain flight logs for up to 10 years based on our legitimate interest, allowing you to reactivate the account and recover professional history.
When you delete your account or request erasure, data is immediately removed from active systems. Backup copies are removed through normal rotation cycles. Remaining data is automatically deleted after 10 years of inactivity if you have made no contrary request.
8. Liability and limitations
8.1 General limitations
Without prejudice to mandatory legal guarantees, including the legal guarantee of conformity for digital services, Skyden is provided as is. To the extent permitted by law, we do not guarantee data accuracy, completeness, or reliability; uninterrupted or error-free operation; or suitability for your particular needs.
8.2 Aviation-regulation compliance
IMPORTANT FOR PILOTS
Skyden is designed to help pilots maintain a reliable and compliant logbook. We make reasonable efforts to align features, calculations, and export formats with major requirements, including EASA and FAA rules.
EASA rules permit electronic logbooks provided, in particular, that required information is recorded, certified by the pilot, and available in a format acceptable to the competent authority. FAA rules also allow pilots to document time in a format acceptable to the administration.
Requirements may vary or change by authority, licence type, operation, and individual circumstances. The pilot must maintain a reliable record and verify its accuracy, completeness, and compliance. Therefore:
- You remain responsible for data entered or imported into Skyden
- Skyden does not guarantee acceptance of every entry, signature, or export in every individual situation
- During an audit or inspection, you remain responsible for presenting and substantiating flight data
8.3 Digital signatures
Signatures recorded in Skyden associate a signature with a flight. They are not qualified electronic signatures under the eIDAS Regulation, and Skyden does not provide identity verification or certification. Their evidentiary value and acceptance depend on applicable rules and the assessment of the relevant authority, employer, or training organization. Skyden does not guarantee acceptance.
8.4 Use at your risk
Subject to mandatory law, you use the Application at your own risk. Skyden is not liable for indirect damage arising from use or inability to use the Service, or from use contrary to these Terms.
8.5 Availability and third-party services
Skyden partly depends on third-party hosting and synchronization services. Maintenance, updates, technical incidents, or provider outages may temporarily interrupt the Service. We make reasonable efforts to limit interruptions and restore service promptly. To the extent permitted by law, Skyden is not liable for a temporary interruption caused by an event reasonably outside its control whose effects could not have been avoided by appropriate measures.
9. Termination
You may end a subscription through App Store settings. Termination takes effect at the end of the current billing period.
We may terminate access for breach of these Terms after a formal notice remains ineffective, except for serious breaches under section 5.4.
After termination, access to some features may be restricted, data may remain available read-only, and no refund is made for an unused period.
10. Governing law and jurisdiction
These Terms are governed by French law. Disputes concerning their interpretation or performance will be brought before the competent French courts.
Before court proceedings, we commit to seeking an amicable solution. You may also use mediation or contact the French Commission for the Evaluation and Control of Consumer Mediation.
11. General provisions
We may change these Terms to reflect developments in the Service, law, or security requirements. Changes take effect when published. Where a material change adversely affects user rights, we will give reasonable advance notice when circumstances allow. A change may take immediate effect where required for legal, regulatory, or security reasons.
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to exercise a right under these Terms does not waive that right.
